These Terms & Conditions govern all direct bookings made through naplesholidayhouses.com for Naples Holiday House (1971 Holiday Ln) and Parrot Holiday House (4459 Parrot Ave), operated by 1971 Holiday Lane, LLC, a Florida limited liability company (“we,” “us,” “the Owner”). By submitting a booking request, you (“Guest”) agree to these Terms.

1. Eligibility to Book
- The primary Guest must be at least 21 years old (under 21 years of age may be granted upon approval) and must be a registered occupant of either property for the full stay — bookings made on behalf of a minor or a third party who will not be present are prohibited.
- Guest must provide accurate identification and contact information upon request.
2. Bookings & Payment
- A reservation is confirmed only upon receipt of the required deposit (50% of total booking cost).
- The remaining balance is due 7 days before check-in and will be charged automatically to the payment method on file unless other arrangements are confirmed in writing.
- Accepted payment methods: Google Pay, Apple Pay, Amex, Visa and Mastercard.
- Rates are quoted in USD and are subject to applicable state and local taxes (Florida sales tax and Collier County tourist development tax).
3. Cancellations & Refunds
- 100% of paid prepayments refundable when canceled 14 day(s) before arrival or earlier. 50% of paid prepayments refundable when canceled 7 day(s) before arrival or earlier. 0% refundable if canceled after.
- No refunds are issued for early departures, no-shows, or reduced length of stay after check-in.
- We recommend Guests purchase travel/trip insurance to cover unforeseen circumstances not addressed by this policy.
4. Severe Weather / Hurricane Policy
- If, at any point during the 5 days immediately preceding a Guest's scheduled check-in date, either property is located within the National Hurricane Center's official forecast cone (5-Day Cone of Uncertainty) for a hurricane or tropical storm, the Guest will receive a full refund of all monies paid, or may elect to rebook alternative dates within 12 months, subject to availability.
- This policy applies only to active NHC forecast cone designations and does not extend to general severe weather, rain, or storms outside a named tropical system's forecast cone.
- Local mandatory evacuation orders issued by Collier County or the State of Florida will also trigger a full refund for the affected dates.
5. Guest Responsibilities & Properties Rules
- Guests must comply with all posted house rules, HOA/community rules (if applicable), and local ordinances at all times.
- No parties, events, or gatherings exceeding the registered occupancy limit are permitted under any circumstances. Violation will result in immediate termination of the stay without refund.
- No smoking or vaping inside either property.
- Only registered Guests may stay overnight; visitors must depart by 10:00 PM / house rule time.
- Pets: Small hypoallergenic dogs under 25 lbs only, permitted with prior written approval and $100 non-refundable pet fee per dog, maximum 2 dogs.
- Maximum occupancy: 10 guests as registered with Collier County.
- Guests are responsible for their own safety around the pool, dock, water access, and outdoor features, and assume all associated risks (see Section 7).
6. Damages & Security Deposit
- No security or damage deposit is required at the time of booking or check-in.
- Guests remain fully responsible for the cost of any damage to either property or its contents, excessive cleaning, or missing items caused by the Guest or their invitees, beyond normal wear and tear.
- If damage, excessive mess, or missing items are identified after check-out, the Owner will document the issue (photos and/or repair/replacement estimates) and notify the Guest.
- Pending a final determination of the damages and agreement on the amount owed, the Owner may place a hold on, dispute, or charge the Guest's payment method on file for up to $500 as a provisional amount to secure resolution.
- If the documented cost of repair or replacement is ultimately determined to be less than $500, the difference will be refunded to the Guest. If actual costs exceed $500, the Owner reserves the right to pursue the Guest for the full documented amount.
- The Guest will be given the opportunity to review the Owner's documentation and dispute the claimed amount before any charge is finalized as non-refundable.
7. Liability Waiver & Assumption of Risk
- The properties include features that carry inherent risk (pool, water access, stairs, outdoor terrain). By staying at either property, Guest acknowledges these risks and assumes full responsibility for the safety of themselves and their party, including minors.
- To the fullest extent permitted by Florida law, the Owner, its agents, and property managers are not liable for any injury, loss, or damage to persons or property arising from Guest's stay, except to the extent caused by the Owner's gross negligence or willful misconduct.
- Guest agrees to indemnify and hold harmless the Owner from any claims, damages, or losses arising from Guest's or their invitees' conduct during the stay.
8. Check-In & Check-Out
- Check-in: 4:00 pm EST / Check-out: 11:00 am EST. Instructions are provided prior to arrival.
- Early check-in or late check-out is subject to availability and may incur a fee.
9. Right to Refuse or Terminate
The Owner reserves the right to deny a booking, or to terminate a stay in progress without refund, if the Guest violates these Terms, house rules, or applicable law, or if the booking was made under false pretenses.
10. Short-Term Rental Registration
1971 Holiday House is registered with Collier County as required under Collier County Ordinance No. 2021-45. DBPR registration number: DWE2103606.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from a booking shall be resolved exclusively in the state or federal courts located in Collier County, Florida.
12. Privacy
Your personal information is handled according to our Privacy Policy.
13. Changes to These Terms
We may update these Terms & Conditions at any time. The version in effect at the time of your booking confirmation governs that stay.
